It is recognized by its brand name AWWBABY.
3. AWWBABY recognises the importance of maintaining your privacy and are committed to protecting the same. We value your privacy and appreciate your trust in us. This Privacy Policy describes how we treat user information which is made available on www.awwbaby.co.in and other offline sources, as well as, an outline of the practices and policies in relation to the collection, use and disclosure of information provided by our Users, when visiting and / or registering themselves on our Website and domain name www.awwbaby.co.in
4. This Privacy Policy applies to current and former visitors to our website and to our online customers / users. By visiting and / or using our Website, you have consented and agreed to this Privacy Policy.
5. Collection of Information:

a. Information voluntarily provided directly to AwwBaby on www.awwbaby.co.in

i. The User is not required to provide AwwBaby directly with any personal information in order to view the Website. However, in order to access and/or use certain content and/or features and/or functions of and/or on the Website, for instance, registering with www.awwbaby.co.in and/or creating a awwbaby.co.in ID or making any payment on the Website, awwbaby.co.in / AwwBaby may ask the User to provide certain information, including but not limited to: 

contact information, such as the User’s name, postal address,email address, phone number, mobile number, delivery address, ip address and contact preferences.

b. Non-personal information automatically collected when the User interacts with the Website of AwwBaby or related links: While the User may visit the Website without revealing any personal information, certain information may be collected by the Website automatically. Illustratively:

iii. webpages and advertisements viewed and/or clicked upon within the

iv. bandwidth speed and software programs installed on the User’s

x. the type of mobile device the User is using or the version of the operating system your computer or device is running. The non-personal information collected automatically on visiting and/or interacting with the Website may be used by the AwwBaby to run algorithms for its own internal analytics and research as to the demographics, interests, and behaviours of various users and to better understand and serve their interests.

c. Modes of collecting information:

The information which is collected through the use of the Website of AwwBabyor otherwise may be collected in one of the following ways:

i. directly from the User, when the User registers on the Website and /s or purchases a product. Similarly, if the User posts a comment on the Website and / or asks us a question through a phone call and / or email.

​ii. through the use tracking tools like Google Analytics, Google Webmaster, browser cookies and web beacons for collecting information about usage of our Website.

iii. from third parties, for example, if the User uses an integrated social media feature on our Website. The third-party social media site will give us certain information about the User. This may include the User’s name and email address.

The information provided to the AwwBaby may be used for the following purposes:

i. to contact the User for confirmation of a purchase on our Website or for other promotional purposes or changes in the Website.

iii. to confirm the User’s registration for an event or contest.

ix. to send you transactional communications wherein emails or an SMS or whatsapp may be sent to the User about the User’s account or a product purchase.

x. to comply with all statutory obligations such as the requirement of the User’s PAN Card in certain circumstances under the Income Tax Act, 1961.

xi. for ensuring compliance with any legal and/or regulatory obligations, including requests if any, from the law enforcement entities and/or to commence and/or defend any legal claim against the User or otherwise.

xii. for purposes as otherwise permitted by law.

e. The other recipients, besides the Website, of the information provided: The information provided to the Website of AwwBaby shall be kept confidential and the AwwBaby will not rent and / or sell such information. However, the said information may be shared and / or disclosed only in certain circumstances, including as below:

i. with third parties who perform services on AwwBaby’s behalf such as the vendors who help us manage our online registration process or payment processors or transactional message processors.

Some vendors may be located outside of India.

ii. ​with the event organizers and / or other parties responsible for fulfilling the purchase obligation. The event organizers and other parties may use the information we give them as described in their privacy policies.

iii. ​with our business partners which may include a third party who provides or sponsors an event or who operates a venue where AwwBaby hold events. Our partners use the information we give them as described in their privacy policies.

iv. with third parties who provide data analysis and/or marketing services for the AwwBaby and enables the AwwBaby to better customize the Website. AwwBaby is not limited in their use of non-identifiable aggregate information.

v.​if we think we have to in order to comply with the law or to protect ourselves, in response to a court order or subpoena. We may also share it if a government agency or investigatory body requests for the purpose of verification of identity / prevention, detection, investigation including cyber incidents, prosecution and punishment of offences, or otherwise it or when we are investigating potential fraud.

vi. for any purpose mandated by law, including requirements of legal proceedings.

vii. ​with any successor to all or part of our business in a scenario wherein all / part of our business is sold, then we may give our customer list as part of that transaction to the successor / future owner.

viii. for the security and protection in any manner whatsoever of the User and/or other users of the Website and/or of the Website and/or of the employees of the AwwBaby, including unauthorised use and/or misuse of the Website.

xi. for reasons not described in this policy. However, the User will be notified about the same, in advance.

6. Security:

a. The security of individual accounts of the User is entirely the responsibility of the User and it is recommended that the User maintains the confidentiality of the

account login credentials, including the password and does not share the same with any third party. For the purpose of password security, it is recommended that:

i. an alpha-numeric password is adopted, preferably using both upper-case and lower-case alphabets and symbols;

ii. the User should avoid such passwords as are obvious, easily identifiable and/or easily predictable; and

iii. the password ought to be changed at regular intervals to ensure better security.

b. AwwBaby and/or its employees and/or affiliates will never ask for the User’s password through any means of communication; the same is required to be entered into by the User on the Website interface alone. Should there be any concern of misuse and/or unauthorized access to the User’s account, the User may inform the AwwBaby immediately at customerservice@awwbaby.co.in

c. It is the responsibility of the User to ensure that irrespective of the nature of the device used by the User to access the Website, the same is secure and all necessary steps are taken to ensure that auto-fillers within the User’s browsers do not cause leakages of critical information.

d. The information provided to the AwwBaby is stored internally on the AwwBaby’s systems and the same is protected against unauthorized physical and electronic access including by way of encrypted data storage, password protected data access, firewall against spam attack and data back-up.

e. As stated above, the information provided to the AwwBaby is shared on a strictly need-to-know basis. AwwBaby does not retain any information for any longer than is reasonably required by it for the purpose of its services or beyond such period as may be required by applicable laws in India.

f. Financial information such as that of the User’s credit and/or debit cards will be dependent on third party payment gateways for security and storing information. The sharing of any and all credit and/or debit card information by the User is at the User’s sole risk.

g. The personal information collected by the AwwBaby may be transferred to, and stored at, a destination outside the European Economic Area (“EEA”). Such personal information may also be processed by staff operating outside the EEA, who work for the AwwBaby or for one of its suppliers, subsidiaries or any other entity. Such staff may be engaged in, interalia, the fulfilment of the User’s request, the processing of payment details and the provision of support services. By submitting personal information, the User expressly agrees to this transfer, storing or processing. For its part, AwwBaby will take all steps reasonably necessary to ensure that the Users’ personal information is securely treated in accordance with this Privacy Policy.

h. AwwBaby takes the security of the Website and User information seriously and will continue to enhance the same from time to time. However, given that by the very nature of transmission of information online, while the AwwBaby will take all reasonable measures to protect User information, the AwwBaby cannot guarantee the absolute security of the information provided to it, particularly in relation to compromise of data as a result of specified hacking. The User hereby absolves the AwwBaby of any liability for any leakage of data and/or information provided by him/her/it and confirms that the AwwBaby will not be held responsible for the same.

7. User’s Rights:

AwwBaby is committed to not use the information provided for any other purposes than what is stated herein in this Privacy Policy. The User has certain rights in relation to his/her/its personal information depending on the country in which he/she/it is located and/or how the AwwBaby interacts with User. Subject to this Privacy Policy, the following rights are available to all Users, irrespective of where they are situated:

a. While the User is not required to provide the personal information that is requested, however, if the User chooses not to do so, in many cases the AwwBaby will be unable to provide the User with its products and / or services and / or respond to any queries that the User may have.

b. Should the User voluntarily provide the information sought while availing the services or otherwise, the User does have the option to withdraw its consent, at any point of time, provided the same is communicated in writing to the Website. Should the User withdraw such consent, the AwwBaby shall have the option of not providing the products / services for which the said information was sought.

c. Access to personal information: The User may contact the AwwBaby at customerservice@awwbaby.co.in and may request that the personal information disclosed to the AwwBaby be shared with the User.

d. Rectification of personal information:
AwwBaby will rectify any incorrect personal information held by it, at the request of the concerned User, addressed to the AwwBaby at customerservice@awwbaby.co.in. It is the responsibility of the User to promptly inform the AwwBaby of any discrepancies in the personal information disclosed to the AwwBaby. However, there may be limitations to the nature and/or scope of the personal information that AwwBaby can and/or will rectify and the AwwBaby reserves all rights in this regard. In certain cases, such as rectifications to name, date of birth etc., AwwBaby may request the User to provide documentary support in respect of the same, to minimise the risk of unauthorised access. In the event that a User chooses to delete any personal information and/or modify it in a way that is not verifiable by AwwBaby, or leads to such personal information being incorrect, AwwBaby may be unable to provide such User with its services and such deletion and/or modification may
be regarded as an intention on the part of the User to discontinue its services.

e. The User may deactivate their account at any time by sending an email for this purpose to customerservice@awwbaby.co.in and/or refuse to provide any of the information required by the Website. In such cases however, while the User may be able to view the Website, they would be unable make purchases of the products / avail of the services as provided, which requires certain information.

f. The User may decline to permit the Website’s cookies if so permitted by their browser. In such cases however, the User may be unable to use certain features on the Website. Additionally, the User can set preferences as to acceptance of cookies from their browser or may delete all cookies from their browser at any time.

g. By default, by registering on the Website, the User will be deemed to have
granted AwwBaby permission to circulate to the User, promotional and other marketing material from time to time. The User may opt out of receiving any such promotional and/or marketing materials, by addressing an email in this regard to customerservice@awwbaby.co.in. It may take about ten days to process the User’s request. Even if the User opts out of getting marketing messages, the Website will still be sending the User transactional messages through email and / or SMS about the User’s purchases

h. A User under the General Data Protection Regulation (EU) / GDPR (“Data
Subject”), has the following additional rights:

i. Access to further information: The Data Subject may contact the AwwBaby at customerservice@awwbaby.co.in and may request details of the source of the personal information and/or the legal purpose of retaining such personal information and/or the entities to whom such personal information may be transferred by AwwBaby and/or the safeguard/agreement under which the

personal information of the Data Subject is being transferred outside of the European Union (in which case AwwBaby reserves the right to redact certain information that the Data Subject is not privy to).

ii. Erasing personal information: The Data Subject may contact the AwwBaby at customerservice@awwbaby.co.in and may request that the personal information collected by AwwBaby be erased from its records and/or servers. However, the www.awwbaby.co.in shall not be bound to erase such information, in inter alia the following circumstances: the information is required to be retained by AwwBabyin compliance with applicable statutory regulations; or to establish and/or defend a legal claim.

iii. Processing of personal information: The Data Subject may contact AwwBaby at customerservice@awwbaby.co.in may request the AwwBabyto stop processing information; however, AwwBabyis not bound by such request in the event that continuing to process the information, overrides the Data Subject’s own interests and/or that AwwBabyis required to establish and/or defend a legal claim against it.

iv. Restricting the processing of personal information: The Data Subject may AwwBaby at customerservice@awwbaby.co.in and may request that the processing of his/her/its personal information be restricted in circumstances inter alia such as: where the Data Subject contests the accuracy of such information and/or where such processing is unlawful and/or where such information is no longer required to be retained by the AwwBaby   and/or where the Data Subject has objected to the processing and the said objection is under process. However, the AwwBaby  shall not be bound by such request, in inter alia the following circumstances: 

• the accuracy of the information contested is in the process of being verified by the AwwBaby;
• to establish and/or defend a legal claim;
• where the User has not withdrawn its consent to the AwwBaby collecting and retaining such information; or
• to protect the rights of another natural / legal person.

v. Portability of personal information: The Data Subject may contact the AwwBaby at customerservice@awwbaby.co.in and may request that: AwwBaby provide the Data Subject with his/her/its personal information in a structured, commonly used, machine-readable format; and the personal information be transmitted by the AwwBaby to another data controller, provided that such transmission is based on the consent of the Data Subject / on the basis of a contract with the Data Subject and that such transmission is carried out by automated means.

vi. Lodging of a complaint: The Data Subject may lodge a complaint, solely at his/her/its own cost and risk, with the relevant local supervisory authority regarding any objection of the Data Subject in relation to the manner in which the information is being processed by AwwBaby.

vii. Automated individual decision making: The Data Subject shall have the right not to be subject to a decision based solely on automated processing unless the said automated processing is necessary for the performance of the contract with the Data Subject / is pursuant to the Data Subject’s consent.

viii. AwwBaby may require certain additional information to ensure that a User falls under the ambit of the GDPR. AwwBaby shall make every reasonable effort to honour all requests of the Data Subject.

8. Third party websites:

If the User clicks on one of the links to third party websites, the User may be taken to websites that AwwBaby does not control. This Policy does not apply to the privacy practices of those websites. It will be the sole responsibility of the User to read the privacy policy of the other concerned websites carefully. AwwBaby is not responsible for the third party websites.

AwwBaby reserves the right to modify this Privacy Policy from time to time at its sole discretion. The User will be bound by the Privacy Policy as modified from time to time.

11. Jurisdiction:

If you choose to visit the Website, your visit and any dispute over privacy is subject to this Policy and the Website's terms of use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India.

This document is published in accordance with the provisions of the Information

Technology Act, 2000, the Information Technology (Reasonable security practices and procedures and sensitive personal data or information) Rules, 2011 and the Information Technology (Intermediaries Guidelines) Rules, 2011.
